The Supreme Court has dismissed an eleventh-hour application from the Attorney General to discontinue a challenge from the Faatuatua ile Atua Samoa ua Tasi (F.A.S.T.) party. 

The court will deliver its decision on the intepretation of Article 44(1A) of the Constitution which was invoked to appoint Aliimalemanu Alofa Tuuau as a 6th woman M.P. 17th May. 

Justice Lesatele Rapi Vaai handed down the decision from the panel of Justices this afternoon.

The Attorney General was acting on behalf of the Office of the Electoral Commission. The A.G. Savalenoa Mareva Betham-Annandale motion that was dismissed relied on a writ from the Head of State declaring the April's results void. 

A separate legal action from F.A.S.T. questioning the lawfullness of the Head of State declaration to annulled the recent election results will be called for mention at 3pm today. 

The decision to appoint Aliimalemanu to Parliament, which was done with reference to a constitutional mandate requiring 10 per cent of all M.P.s be women expanded the size of the Parliament and led both F.A.S.T. and the Human Rights Protection Party (H.R.P.P.) into a 26-seat all draw.

The Head of State on Tuesday declared the election would be voided with a snap second election to be called on 21 May.
