Conspiracy trial comes to an end
The trial of La'auli Leuatea Schmidt, Fepuleai Faimata Su'a, Samuelu Su'a, Sivai Kepi, Lise-Marie Schmidt and Li'o Fa'ataumalama has concluded after all six accused have chosen not to give evidence.
The six have denied charges of conspiracy, fabricating evidence, and defamation.
On Wednesday, the prosecution presented only one witness, and after her short testimony and cross-examination, the prosecution closed its case. The defence counsel informed the court that they would not be presenting any witnesses, marking the end of the five-week trial.
The trial began with a prosecution witness giving evidence via a video link from Australia in the high-profile conspiracy trial, denied an evening walk with Sivai Kepi, where she showed her a vehicle belonging to Lealailepule. This was the last prosecution witness.
Poufa Ah Sio told the court that she was shocked when she came for her mother's funeral last year and was approached by police about her involvement in this matter.
In her evidence, she told the court that she didn't want her name to be involved in a case because she didn't know what was going on.
During cross-examination, inefficiencies in the translations were also exposed. Defence lawyer Kathryn Dalziel asked Ms Ah Sio if the police had forced her to say that she was not with Sivai when she was allegedly showing a vehicle that belonged to Lealailepule. She responded, Yes. However, she added that she wanted to speak to the police because her name had been involved in a case which she had no knowledge of.
Dalziel again told Ah Sio that Sivai never mentioned a car that belonged to Leala. The witness said that the police had informed her that it was Sivai's statement.
After the prosecution's last witness, Judge Tala Atoa-Sa'aga adjourned the matter for all counsels to file their closing submissions.
Prosecutor Leinafo Taimalelagi-Strickland has until 4 August to file her closing submission while the defence counsels have until 1 September.
All final submissions will be heard in court on 6 October.
