The Court of Appeal will hand down its ruling this Friday on whether to overturn a 2019 Supreme Court decision that ruled against former Manu Samoa coach Fuimaono Titimaea Tafua.

Fuimaono took the Samoa Rugby Union [S.R.U.] to court last year after it terminated his contract, arguing that the decision was unfair. But the Supreme Court dismissed the lawsuit at that time.

Lawyer Leulualialii Tasi Malifa, who is representing Fuimaono in the Court of Appeal, told the court on Monday morning that if it upheld the 2019 decision of the Supreme Court then “it's as if they [SRU] can do whatever they want.”

The Court of Appeal comprised three judges: Justice Vui Clarence Nelson, Queen’s Counsel Justice Robert Lloyd Fisher and Justice Sir Peter Blanchard [Privy Council].

Justice Fisher and Justice Blanchard sat through the proceeding through video link.

The judges reserved their decision and adjourned the hearing to this Friday, August 7 for decision.
