Prosecution separates charges for mother and son
A mother and son who were initially charged by prosecution for negligent driving causing death appeared again in the Supreme Court on Monday, with the prosecution filing different charges for the two.
The mother of the 13-year-old who drove the car was charged with allowing her son to drive a car without a valid driver's license. The teenager remains charged with negligent driving causing death.
It is alleged that a man sitted in the tray of the truck driven by the teenager lost his life as a result of the accident.
Judge Justice Fepuleai Ameperosa Roma told the prosecution that the matter should be transferred to the Youth Court, and from there, their application for the young defendant to be charged in the Supreme Court should be decided.
"I don't make that call; it is the Youth Court's decision to be made," Justice Roma said.
The young teen is facing four charges, which include the main charge of negligent driving causing death.
Prosecution was told by Justice Fepuleai last Monday to reconsider a charge for the mother of the boy who drove the car because a car can only be driven by one person.
The woman pleaded not guilty.
Justice Roma scheduled a hearing for the week commencing 20 July 2026.
As for the first defendant, his matter will be called before the Youth Court on 10 December if the application by the prosecution for his matter to be heard in the Supreme Court is not accepted.
