Conspiracy trial: Judge criticises leak of chamber discussions

District Court Judge Talasa Saaga has expressed strong disapproval over the publication of information discussed in chambers, following a Samoa Observer report that she had rejected a “no case to answer” application in an ongoing criminal trial.

In court on Wednesday, Judge Saaga raised concerns about the article’s timing, noting that her position on the application had not been formally addressed in open court at the time of publication. The story, citing a reliable source, reported that the application made by defence counsel on Tuesday morning had been denied.

Judge Saaga clarified that the matter had been discussed privately in the chamber. She also indicated that the court is investigating how details from a confidential judicial discussion were disclosed to the media.

The judge reminded media outlets of the Media and Court Reporting Guidelines, which outline boundaries for reporting on court proceedings, particularly concerning closed discussions and confidential matters.

While acknowledging the media’s role in keeping the public informed, Judge Saaga urged restraint and strict adherence to proper court processes. She cautioned journalists against reporting on information obtained from chamber discussions or outside sources.

Judge Saaga also issued a directive prohibiting witnesses who have already testified from making public comments about the case, including on social media.

Six individuals, including two former Members of Parliament and a former police officer, are on trial facing charges of conspiracy to defeat the course of justice, defamation, and harassment in connection to a 2021 hit-and-run incident at Vaitele.
