Brothers face burglary trial next year

Two brothers will stand trial next year for aggravated robbery charges in connection with the alleged beating of businessman David Main outside the McDonald's restaurant in September of 2018.

Supreme Court Justice Leiataualesa Daryl M. Clarke on Tuesdayn morning set the trial date for Richard Burgess and Davis Burgess for 21 February.

Both men are accused of beating Mr. Main across the street from the McDonald’s restaurant.

They deny the aggravated robbery charges.

While Richard did appeared for the hearing to set a trial date, Davis did not.

Richard was remanded on the same bail conditions and was told by Justice Leiataualesa to re-appear on 1 February for trial.

He was also instructed to remain in contact with his lawyer leading up to the trial next year to make appropriate preparations.

Prosecution was directed to file trial documents no later than Friday, 6 November, 2020.

Davis, who is out on bail, must appear before Justice Leaiataualesa on Tuesday, 23 June at 10am for mention.

Richard is being represented by Theresa Momoisea.

The defence attorney for Davis is Leiataualesa Komisi Koria.
