Man jailed for theft, indecent assault
A twenty – two year old man from Vaivase-tai will have six years in jail to learn his lesson.
That’s how long Supreme Court Justice Vui Clarence Nelson has sent him to jail for a number of offenses.
A suppression order was issued to protect the identity of the victim.
This was not extended to the defendant, Avei Luao, who faced six charges including attempted sexual violation.
The prosecutor was Vaisala Afoa and while the defendant was unrepresented.
Luao was charged of burglary, theft, common assault, indecent assault, attempted sexual violation and one count of misleading by telling the Police a wrong name.
According to the police summary of facts on the 24th December 2016 at around 4am, the defendant removed louvers of the windows in the living room and entered the complainant’s house.
While in there, the defendant stole $300 cash. He then went inside the victim’s room where she was sleeping.
While in there, he got on top of the victim and strangled her. She woke up and tried to scream but the defendant blocked her mouth.
He then indecently assaulted her.
The victim managed to scream which woke up her brother who was sleeping in the other room.
But the defendant fled with the victim’s brother chasing after him.
He was apprehended by neighbors and taken to the Police Station.
The defendant is single and unemployed.
