Date given for hearing of top cop application for stay in proceedings

Chief Justice, His Honour Patu Tiava’asue Falefatu Sapolu, has granted an early hearing date for the application for a stay in proceedings in relation to the charges against the suspended Police Commissioner Fuiavailili Egon Keil. 

The matter was adjourned from last week to allow the Supreme Court to consider the application filed by lawyer, Lei’ataualesa Komisi Koria.

It was also to give time to the prosecution to file a response.

In Court on Monday, Lei’ataualesa asked for an early hearing date as there is urgency in this matter to be resolved. Ofisa Tagaloa who appeared on behalf of the prosecution did not object.

Chief Justice Patu accepted the application and adjourned the matter for hearing on the 16 January 2017. 

Meanwhile three of the four incite to murder charges against Fuiavailili have been withdrawn.

Other charges include unlawful possession of a firearm, intimidation and using insulting words. The prosecution is seeking to have most of the charges heard in the District Court but the defence is asking for all charges to be heard in one court.
