Pathologist report on death of two babies wanted

The lawyer representing two nurses accused in the death of two babies who died after being administered the Mumps, Measles and Rubella (MMR) vaccination last year has asked the Court for a copy of the report from the Pathologist.

Lawyer, Tauiliili Lefau Schuster, represented nurses, Leutogi Teo and Luse Emo Tauvale before the Supreme Court Monday. Lucy Sio – Ofoia, of the Attorney General’s Office, was the prosecutor. 

Tauili’ili told the Court he has been served with the files for the matter but not the Pathologist report.

“Your Honour I ask the Court if the prosecution could also serve the Pathologist report,” said Tauiliili.

In response, Mrs. Ofoia said she has not been notified if the Pathologist report has been issued. 

She asked for an adjournment to allow for her Office to locate the file. 

Chief Justice, His Honour Patu Tiava’asue Falefatu Sapolu granted the request. 

The matter has also been scheduled for a hearing on 10 June, which both lawyers agreed to. 

Both Ms. Teo and Ms. Tauvale are facing charges of manslaughter, conspiracy to defeat the course of justice and negligence in relation to the deaths.

They have pleaded not guilty to the charges. 

In the meantime, the suspension on the MMR vaccination has not been lifted since July last year.
