Father reoffends when visiting his family

A prisoner and a stepfather accused of telling his stepdaughter that her womanly fluid would cure his cancer has been found guilty of indecent assault.

The father from Iva Savai’i and Tanumalala Prison, whose name has been suppressed, was found guilty by the Chief Justice, His Honour Satiu Simativa Perese on Friday.

He pleaded not guilty to one count of indecent assault.

The alleged incident took place at Vaoala in April 2018 when the defendant was serving an eight year sentence for a separate offence.

According to evidence before the court, the prisoner was granted a warrant to visit his family home by way of an escorted outing under the Prisons and Corrections Regulations 2014.

The court heard that the warrant notes the purpose of the visit was for the defendant to see his sick daughter.

Chief Justice Satiu found that prosecution has proven beyond reasonable doubt that at Vailoa Faleata on 23 April 2018, the defendant did an indecent act on the complainant.
