Rape sentencing adjourned

Sentencing for a man who pleaded guilty to rape has been adjourned in the Supreme Court.

The defendant, Pili Poloai Niko, appeared for sentencing before Supreme Court Justice Leiataualesa Daryl M. Clarke on Friday afternoon.

Defence counsel Leota Tima Leavai told the court she was not ready to proceed to sentencing because she had just received reports from probation services electronically the night before.

She said she has not received the hard copies of those reports.

Leota also pointed to an issue with the Summary of Facts.

Niko’s sentencing has been adjourned to 12:30 p.m., Thursday, 20 August, 2020.

“He pleaded guilty to rape so he’s not going anywhere anytime soon,” said Justice Leiataualesa.

The prosecutor on the case is Fuifui Ioane with the Attorney General’s Office.

Justice Leiataualesa informed the defendant that his attorney is not ready to proceed with sentencing.

Niko was remanded in custody to re-appear on 20 August.
