Man in court for assault, armed with weapon

A man facing charges of assault causing grievous bodily harm and being armed with a dangerous weapon will appear in the Supreme Court on June 23.

Defendant Isaako Alaimanu appeared before Justice Leitaualesa Daryl Clarke on Tuesday, though prior to his appearance, defense attorney Leota Tima Leavai advised the Court that she is not representing him.

According to the Court listing, Leota is the counsel for the defendant but she advised in Court that she has not received instructions from the defendant.

Justice Leiataualesa said: “I don't know why. Maybe someone told us you were counsel. All right, you are not counsel. Let the Court records note that Ms. Leavai is not counsel.” 

The defendant was then asked by Justice Leiataualesa if he wished to enter a plea or engage counsel, and advised that if he could not afford an attorney the Government would pay for his lawyer.

In response, the defendant said he wished to engage a counsel. 

Justice Leiataualesa set the matter down for Tuesday, 23 June to allow Alaimanu to engage counsel and remanded the defendant on bail and told him to follow his bail conditions. Thirty-five matters were on Justice Leiataualesa’s Court list for Tuesday but more than 10 matters did not proceed, because the defendants were not summoned to appear in Court.

Those matters have been rescheduled to appear later this month.
