A civil claim filed by the Samoa Land Corporation against Farms Supplies Limited owner Papali’I Panoa Tavita was called for mention in the Supreme Court yesterday.

The claim is in relation to S.L.C. land lease payment at Nu’u and an eviction order sought for Farms Supplies Limited amongst other claim.

Attorney General’s office lawyer, David Fong represented S.L.C. Papali’i did not appear in Court nor did a counsel to represent him.

Supreme Court Judge, Justice Mata Keli Tuatagaloa presided the matter.

The Court heard the defendant was previously represented by lawyer Ruby Drake but counsel is no longer acting for defendant.

Mr. Fong told the Court there has been a delay in serving the defendant.

“We attempted to serve the defendant this morning, he has refused to sign receiving service,” said the lawyer.

“But he has received it.”

Justice Tuatagaloa then ordered to re-summon the defendant.

The matter has been adjourned to April 23 for mention.

The civil claim is separate from a lawsuit filed by Papali’i against the corporation. That lawsuit is in relation to a $500,000 loan and a contract of partnership between the parties.
