Court decision adjourned

A Supreme Court decision on an injunction application filed by Associate Minister Peseta Vaifou Tevaga’s lawyer, Leulua’iali’i Olinda Woodroffe, has been adjourned to Friday. 

The injunction application relates to a dispute with Apulu Lance Polu; Speaker of Parliament, La’auli Leuatea Schmidt and Martin Schwalger, in relation to the company Local Partners and Associates (L.P.A).

Those three respondents are represented in court by lawyer, Semi Leung Wai.

In court on Monday, both counsels disputed Peseta’s role in the company.

Mr. Leung Wai argued that Associate Minister Peseta was neither a shareholder nor a Director of the company, Local Partners and Associates Ltd. 

He told the Court that Lei’ataua Danny Schwenke (Peseta’s son, who transferred his shares to his father) was the rightful shareholder of the company and the Director. 

However, Leulua’iali’i argued that her client was the shareholder and the Director of the company. 

Both counsels were given the chance to recommend someone to run the company until the dispute was settled. 

Mr. Leung Wai informed the court that they had approached the Samoa National Provident Fund, and suggested the S.N.P.F could run the company.  Leulua’iali’i told the Court that her client did not agree with that move, and said that, for the company to go ahead, it needed someone independent to be in charge.

She recommended two individuals to the Court, to run the company, and presented their resumes.

She said they could work together to run the company under the orders from the court, and confirmed they had no conflict of interest to the directors or the company.

Justice Lesatele adjourned the matter to deliver his decision on Friday.
