The hearing of the appeal against the conviction of former Director of the National Prosecution Office, Mauga Precious Chang, has been scheduled for 6 December, 2017.
However the matter was on the calendar for criminal mention in the Supreme Court. Defense Counsel Aumua Ming Leung Wai who represents Mauga informed the court the Attorney General was not told of the Appeal.
Kirsten Kruse appeared on behalf of the independent prosecutor Satiu Simativa Perese.
The application was made before Chief Justice, His Honour Patu Tiavasue Falefatu Sapolu on Monday.
“Your Honour I have just noticed something this morning [Monday],” said Aumua.
“The Attorney General was not advised of the appeal and he has to seek leave of this court so my application for this matter Your Honour is to ask that it be adjourned for two weeks so we can obtain further instructions.”
Chief Justice Patu granted the application made by the Counsel.
“This matter is further adjourned for re-mention on Monday 17th July,” he said.
“Should the appeal go directly to the Court of Appeal I think the motion needs to be amended so it shows that it files directly to the Court of Appeal and not to this court.”
Last month, Mauga was found guilty of negligent driving causing injury charge. She is appealing the decision by the Supreme Court, through her counsel, Aumua.
